The lawyers of the former president of Honduras Juan Orlando Hernández presented an appeal for protection in the Constitutional Chamber of the Supreme Court of Justice against the resolution of the ex-president’s extradition to the United States , who claims him to face charges related to drug trafficking, Judiciary spokesman Melvin Duarte told CNN.
The plenary of 15 magistrates of the Court ratified on Monday the ruling of a natural judge so that Hernández is extradited.
According to Duarte, the Judiciary must appoint an ad hoc chamber with magistrates who have not acted before in the case of Hernández’s extradition to resolve the petition raised by the defense of the former president.
The judicial spokesman assured that this resource does not delay the administrative process in which the former president’s case is found, which consists of the drafting of the resolution issued by the Court of Appeals that ratifies the extradition of Hernández.
Once the resolution is drafted, according to Duarte, the signature of the 15 magistrates will be collected and the file passed to the natural judge who will decide at the time whether to proceed with the process and send the case to the Ministry of Foreign Affairs to coordinate. extradition with the US government or wait for the ad hoc chamber to resolve the last appeal filed to continue with the process.
Hernández, who has repeatedly declared himself innocent of the charges brought against him by the US justice system, has been held since February 15 in the National Directorate of Special Forces, waiting for the Honduran justice to decide on the day of his extradition.
