Musk’s response to Twitter lawsuit will be known Friday

Elon Musk’s response to Twitter’s lawsuit over his attempt to back out of a $44 billion deal to acquire the social media company will be made public no later than Friday afternoon, a judge ruled Wednesday.

Musk’s attorneys wanted to file a public version of his answers and counterclaims in a Delaware court on Wednesday. But Twitter’s legal team complained that they needed more time to review and possibly redact the confidential documentation submitted by Musk, saying it makes “extensive” reference to internal information and data that the company provided to Musk.

Delaware Court of Chancery Judge Kathaleen St. Jude McCormick held a brief conference call Wednesday before accepting Twitter’s argument, ordering that the public version be delivered by 5 p.m. Friday. It could come sooner, depending on when Twitter’s lawyers complete their review.

Twitter’s lawyers argued that court rules require five business days before a public version of Musk’s filing is filed.

“Few cases attract as much public interest as this one, and Twitter is aware of this court’s commitment to ensuring maximum public access to these proceedings,” said company attorney Kevin Shannon. “Twitter has no interest in proposing more censorship than necessary to the defendants’ response.”

Musk’s attorney, Edward Micheletti, argued that Twitter’s legal team misread the court’s rules. Musk’s attorneys say there is no confidential information in Musk’s presentation that should be kept out of the public eye.

“Twitter must not be allowed to continue to bury the side of the story it does not want to reveal publicly,” Micheletti wrote.

Shares of Twitter closed at $41 on Wednesday, well below its 52-week high of $68.81.
